Indian jails are flooded with thousands of innocent people yet, they were forced to languish in jail for years. Why most Indian prisoners fight long battle for justice? This is a big question which can understand a lay man of India but, beyond the comprehension of our collapse judicial system. Despite being innocent, Police makes them voluntary accuse and file fabric charge seat. We are required to reform of judicial system specially Police which makes voluntary accuse the poor innocent who barely knows how to sign and, even due to come from economic weeker section they can't afford advocates for bail,.

If before registering named FIR in heinous cases Police worked on the factual ground,  certainly the number of innocent going jail would be less. Suppose to be, somewhere in any Police Station jurisdiction phenomenon of murder takes place, and the concerning Police station register prosecution against a person, That is primafacia duty of Police but, second duty of Police is not to arrest the man against whom FIR register Police should investigate the matter untill unless find solid intention as well concrete evidence of murder. But, Indian Police does not work on merit, only pay it's duty even if someone life can spoil, no problem.

Now, We should have understand by few case incidents which has been taken places in Indian judiciary.

In 1996, a team of Delhi Police bundled a man of 25 Mohmmad Ali Bhatt  into his car from Kathmandu Nepal by alleaging that he was involved in bomb blast of Lajpat Nagar Delhi. He hailed from Kashmir a shawl trader in Nepal capital. He was brought Delhi and later on Rajsthan because he was made accused for an other blast in Rajasthan. He was belonging from poor family as well nor well educated and, he has to spend 23 years in jail of his life. Finally, Rajsthan HC found him not guilty and, released him after 23 years. Why was Mohmmad Ali Bhatt to force languishing in jails for 23 years of his prime age? It was nothing except lethargic judicial system as well his poverty that he could not afford advocate. Dispite being innocent, if a man was forced to languish in jail for 23 years and, he is released saying this, that he is innocent. Is it justice?  No, This is not justice, This is Mass  Rape of Law and, The rapist of law is been whole this

The case of Mohammad Ali Bhatt is not lonely, The history of such cases like Mohammad Ali Bhatt is flooded in Indian Judiciary.

In an other case, Mohammad Maqbool Shah was also arrested in 1996 for same blast case of Lajpat Nagar Delhi like Bhatt. In 2010, Delhi lower court concluded that Mohammad Maqbool Shah was innocent, it was a big mistake of Police that without proper developing his investigation, Delhi Police made accuse him. When Shah was released from court in 2010. Despite being innocent, he had to languish in jail for 14 years. When he got back his home from jail,  in Kashmir his father and sister were dead and, his home were destroyed as well his entire life had been ruined. Indian judiciary pated his back by saying this that, arresting and imprisonment of  Mohammad Maqbool Shah was mistake of law. I think after passing long time of 14 years  imprisonment admitting mistake of law is not enough. Let's supposed that  was mistaken of law and Police, why the same mistaken never happened with the high profiled political statures as high commissioner V.K. Krishana Menon in the matter Jeep Scam? Why didn't with Bo-force scam, 2G scam,? Over all the mistake of law's story is been endlesd repeated with innocent, poor and peasants. What about the Police officers who arrested him and despite being innocent made him accused for so heinous crime which was committed by conspirators. If arresting a person on the fabricating facts is duty, I will say it's not any duty, it is mass rape and murder of law?

One more case from Bijnor Uttar Pradesh, Police arrested a person name Bala Singh in murder case what he never committed. His was a daily- wage labourer, Pleaded before Police and, in court that in the matter of murder Police voluntary making mistake. After spending 10 years in jail, he was set free by saying this that he is innocent. The murder for which Bala Singh was arrested, was committed by his brother.

What Common in the Case of Bhatt, Shah and Bala Singh?

One thing is common in the case of these three men. These three were innocent, poor and illiterate as well great factor of their going jail they didn't have any social,  political and economical approach and came from economic weeker section of the society. If they had financially strong as well have political stature,  On being criminals they certainly would not have to go to jail. As we have seen in many cases, many parliamentarians either committed crime or they were been indulged yet, they were never ever sent to jail nor they were forced for languishing jails for years. If sometimes they had to go to jail, they got VIP treatment as- reserved room with full of luxurious articles as room of any five star hotel. This is called law is equal to all, let me know where is equality? If there any biggest lie in our democracy, that is law is equal for all?

Finally, I come on conclusion of above three case, If there any who is unable to afford advocate and, fighting for justice, Indian Courts and government should strongly fight case for such persons' justice. I never say this that any criminal should left but, I would like to appeal with Judiciary that before sending anyone's in jail at least examine him on behalf of court.

History of Indian jails is flooded with such people like Mohammad Ali, Mohammad Maqbool and Bala Singh. An other hand,  the powerful people who were been indulged in heinous crime like loot, murder and rape and made a never lasting criminal record in the world of crime. Despite having endless criminal history, in place of sending them jail they were elected for state legislative assemblies as an MLA or elected as parliamentarians. How ironic is this, that they who never committed any crime, they were forced for languishing in jails for years and, other hands are those who are having endless criminal history, they are sitting in parliament as a parliamentarians

Thinking of a common man?

I am having to say with great regret that in presently social, political environment and  circumstances, if there any lay man is tortured by any un-social element, in place of going to Police or Court, the common man likes either to go to any bigger criminal for getting justice or if he is little bit capable, he gets up the arms in his hand for shooting him dead and becomes criminal. I mean to say that today's in place of going to Police or court, taking law in his hands seems him to be more easy.

*Criminals are better than innocents poor?*

According to a report of ADR 2019, published in Times Of India and in The  Hindu news paper that around 50 per cent winning parliamentarians in lok sabha election of 2019 declared against them criminal cases. Just a little think, if there anyone who has even a single criminal case of bread stealing, even if that is fabricated of mean Politics or Police, the person against whom case filed can never get a government job of peon neither the person against whom is filed any case of stealing could be a home servant but, an other hands are they who have endless criminal history can reach to the highest house "Parliament of India." Why? Now speak frankly, Law is equal for all how? Make me clear this discrimination.

Now once again I come to the point, Nearly 50 per cent parliamentarians are those against them criminal cases are filed in loot, murder and even the rape too but, having won the election under article 368 of Indian constitution they exercise their power in making new law. Now just a little think if there any criminal is empowered for making law, how would be the law?

The book, "Mass Rape of Law?" is not just a book to be read and put aside. This book is based on today's legal, social and political decline. Along with reading this, there is a need to improve by realizing the current conditions and circumstances. You will read in this how the corruption-ridden on judicial system of the country has spoiled not only the judiciary but also the fabric of the social structure. I have absolutely no hesitation in saying or writing that, The judiciary of the country has been subjected to economic powers, even if he is a big criminal. To say that the country runs according to the Constitution, from the road to the parliament, everything is under the Constitution, and in this Constitution we have been taught that the law is equal for all, that is, equal, whereas, the truth is, There is no bigger lie in the Constitution than this. I do not mean at all that there was any ideological deficiency in the framers of the Constitution, rather, the present political situation has proved the constitution and law wrong due to self-economic gain and corruption. So I request my readers to read it, analyse it and then tell me to what extent what I have tried to write is true and to what extent it is wrong. I wish to put the nude truth before my readers of Indian judicial system how the law gets break by few criminals and politicians and, how they defend themselves by managing judicial system. also, keep giving me your suggestions from time to time, this will guide me and, in future, I will be able to serve you and my country well.
