Triple Talaq - A social evil ?

Triple Talaq is a contraversial word towards humanity. Triple Talaq is some times consider as a Social evil. But What is truth towards it is known by few peoples only. Even Muslims are also unaware towards this System of Divorce under Islamic rule.

The word 'Talaq' looks itself contraversial.
The word 'Talaq' is an Arabic word which means Divorce. The oldest codified law in the history of divorce was traced in 1760 B.C. during the reign of King Hammurabi of Babylon. Which means this concept is much older than the arrival of Prophet (pubh).
But then why it is so contraversial ?

It is so contraversial that 23 countries have banned it including India, Pakistan, Bangladesh etc. It is contraversial because it this type of Divorce Only Muslim mens ( husband) can grant divorce to there  womens(wife). Womens don't have any right to give Talaq. Under this rule husband shall say the word 'Talaq' to his wife three times. And the marriage ends. There are some cases in which husband give their wife Talaq on phone call or sms. Which is also considered as legal.

According to the findings of a BMMA study, more than 90 percent of 4,710 women interviewed wanted a ban on unilateral divorce.

But it is really a truth ?

Some times consideration of this type of Divorce make the society unhappy. But all you have read is not truth. But some questions arise in our mind ?

Why mens have only right to grant divorce ?
To answer this we must know about types of Talaq in islam
In Islam, divorce is permitted, but considered a last resort. Here are the main types of divorce:

*Initiated by Husband:*

1. Talaq-e-Ahsan (Recommended Divorce):
    - Husband pronounces talaq once.
    - Waits for wife's menstrual cycle (iddah).
    - Can revoke divorce during iddah.
2. Talaq-e-Hasan (Good Divorce):
    - Husband pronounces talaq three times, spaced over three menstrual cycles.
    - Can revoke divorce during iddah.
3. Talaq-e-Biddat (Innovative Divorce) / Triple Talaq:
    - Husband pronounces talaq three times in one sitting (considered invalid by many scholars).

*Initiated by Wife:*

1. Khula (Redemption Divorce):
    - Wife seeks divorce, returning dowry (mahr) or other compensation.
    - Mutual consent required.
2. Mubaarat (Mutual Divorce):
    - Both spouses agree to divorce.
    - Terms and conditions negotiated.

*Other Forms:*

1. Faskh-e-Nikah (Annulment):
    - Divorce due to spouse's inability to fulfill marital obligations.
    - Requires court or Islamic authority intervention.
2. Talaq-e-Tafweed (Delegated Divorce):
    - Husband delegates divorce authority to wife.
    - Wife can divorce herself.

*Important Notes*

1. Divorce should be a last resort.
2. Reconciliation (Muslih) encouraged before divorce.
3. Islamic scholars and authorities should be consulted.

So the Question why men can only Grant divorce is "Null and void" Because womens have also right to grant divorce (as mentioned above).

But to the Point Triple Talaq
Triple Talaq is a type of Talaq which is not acceptable in the Muslim Society. It is also considered invalid by some of the Religious scholars.
In fact Two of the Jurisprudence out of four
Shafl'i and Maliki schools restrict or prohibit it. Shia islam generally rejects it.

The point of rights of womens in islam
Islam Grant equality towards womens not only in terms of Divorce but throughout the surface. In fact in quran (4:1, 33:35) mention about equality in islam towards womens.
